Court grants Kris’ TPO petition against James

Atty. Frank Chavez, TV host-actress Kris Aquino's legal counsel revealed that the court has granted Kris’ petition for a temporary protection order (TPO) against her former husband James Yap, whom she accused of “abuse of visitational rights” and inflicting psychological harm on their son Bimby.

The TPO is said to be good for 30 days, but Kris’ legal counsel makes a petition to make the protection order permanent. The proceeding is rescheduled on April 8 to 10.

“The update is that the court granted the Temporary Protection Order and it mandates that James Yap cannot approach Kris, Bimby and the housemaids at a distance of less than 100 meters. Yap has to stay away from Kris and the child and any household members at a safe distance but not less than 100 meters. He also has to stay away from the residence, school, place of employment and any specified place recounted by Kris, the minor and the household members,” Atty. Chavez told Yahoo! Philippines OMG! over the phone on Wednesday, March 20.

The petitioned mentioned an encounter where James visited Kris’ condominium last December 2012.

“It granted the application of Kris on the basis of the allegations stated in her petition that James has abused his visitational rights and has in fact meandered to a forbidden territory by forcing himself on Kris Aquino, despite the fact that they are no longer husband and wife,” he said.

Atty. Chavez also denied accusations that Kris was just making up stories. He added that James admitted in his press conference on Wednesday that he attempted to kiss Kris and justified it as a “joke.”

“And he in fact admitted that he did attempt to Kris Aquino, but justified it by saying that it was just a joke. He in fact admitted so it was contrary to what they’re saying that all of these were all just made up by Kris Aquino,” Atty. Chavez said.

James also allegedly inflicted psychological harm to the 5-year-old Bimby.

“Yes, because of various incidents. One on December 3, 2012, where he attempted to inflict himself on the mother in the presence of the child. This freaked out the child and the child, in fact, placed himself between the parents and pushed the father out of the room, slammed the door and locked it,” he said.

Atty. Chavez also added that James broke promises to his son. Bimby also refuses to talk to James.

“In January, 2013, he also broke a promise to the kid. He said he will give him an X-Box, provided that the child will go see him in Serendra. The child went there but there was no gift. On March 8, he wanted to talk to the child, but the child refused to talk to him. The March 13 incident was also recorded and submitted to the court. That he just wants to talk to the child and the child just simply refuses to talk to him,” he said.

Atty. Chavez said that their next plan is “for the court to hear the case.”

“We will present our witnesses to support our allegations,” he said.

Kris is consistent in saying that she and James are not friends. Before  her birthday last February, Kris tweeted about signing a check in the amount of millions of pesos, which many people think was for James.

“Nag-emote lang talaga kasi mahirap talaga mag-sign ng mga papeles na ganoon. Anybody in that position, no matter how much you have, will identify where I’m coming from. Pero tapos na iyon,” she said in a previous interview.
